Separation of Powers

Abstract

Why is there a need for separation of powers in football? It is not enough that the separation is carried out with a clear job descriptions, but each individual in it is in the same area of power.

Good Governance in Football

Experts agree that good governance is an ideal concept to achieve its goals.

Governance means action or manner of governing a state, body, organisation system by which an organisation is controlled and operated. In football world, good governance has several areas, namely:, accountability checks and balances, democracy, transparency, separation of power and integrity.

Why separation of power is a part of it? It is said that the purposed of the separation of powers is both to prevent abuses of power and to best protect the community as a whole. (Dr Jonathan Collinson.)

If we look at the project life cycle theory by Winston W. Royce, there are 5 stages that must be carried out to ensure the target achievement. Starting from initiating to closing. Each stage cannot be done by one part alone. The creator of the work cannot monitor the results of his own work. Therefore, a role at the next level needed to ensure a process, this known as separation of powers.

Separation of power

In football, this separation of power is divided into congressional power, where the resulting decision is a decision made by majority agreement by all members. The resulting decision cannot be overturned, other than through the congress itself. This congress decision is the highest decision that produces a long-term work program, organizational vision, a review of the implementation of work programs, as part of monitoring and etc.

Then, the area of judicial decisions which is the result of a judicial review. It is independent.

Next is the area of decisions made by the Executive Committee. This decision shall be based on the powers conferred by the Statute.

For example, when a football organization wants to set a long-term plan. The Executive Committee area will produce a proposals, the proposals are based on input from the implementation of General Secretariat work. Thus, the proposal will be one of the Congress agenda, and if the majority of decisions at the congress agree that the decision will become a congressional decision, which the organization can legally implement, at various levels. Monitoring of the results of the work will go into the judicial bodies which is divided into ethic, disciplinary, and appeal. In addition, there is a compliance department that ensures the general secretariat is running in the right direction.

Conclusion

Separation of power in football, needed to ensure target achievement. As well as preventing the occurrence of various things such as corruption, minimizing the risk of failure of work programs, as well as the risk of violations of power.

Without this, the achievement of a football organization both in terms of managerial and technical achievements will be difficult to realize.
